DH Cubed, LLC ("we," "us," or "our") operates the ErgoSharp website at ergosharp.com (the "Site"). This Privacy Policy describes how we collect, use, disclose, and protect your personal information when you visit our Site, make a purchase, or interact with us.

By using our Site, you agree to the collection and use of information as described in this policy. If you do not agree, please do not use our Site.

Information You Provide Directly

When you interact with our Site, you may voluntarily provide us with personal information, including:

  • Order information: billing and shipping addresses, payment method details (processed securely by Shopify Payments — we do not store your full credit card number), and purchase history

  • Meta Pixel: We use the Meta (Facebook) Pixel to measure the effectiveness of our advertising and to deliver relevant ads. You can manage your ad preferences in your Facebook Ad Settings.

2. How We Use Your Information

We use the information we collect to:

  • Process and fulfill your orders, including shipping and payment processing
  • Provide access to our online training modules (Sharpening Universal Curettes, Sharpening Gracey Curettes, Sharpening Sickle Scalers)
  • Communicate with you about your orders, account, or customer support inquiries
  • Send promotional emails and, where you have separately opted in, marketing text messages about new products, special offers, or educational content — you may opt out of either at any time
  • Improve our Site, products, and services based on usage patterns and feedback
  • Measure advertising effectiveness and deliver relevant advertisements
  • Detect, prevent, and address fraud, security issues, or technical problems
  • Comply with legal obligations

3. How We Share Your Information

We do not sell, rent, or trade your personal information to third parties.

We may share your information with the following categories of service providers who assist us in operating our business:

  • E-commerce platform: Shopify hosts our online store and processes transactions on our behalf
  • Payment processors: Shopify Payments (powered by Stripe) processes your payment information securely
  • Shipping carriers: We share your name and shipping address with carriers (such as USPS, UPS, or FedEx) to deliver your orders
  • Analytics providers: Google Analytics and Meta help us understand Site traffic and advertising performance
  • Security services: hCaptcha provides bot protection for our Site
  • Email and text message providers: our marketing platforms deliver the messages you have asked to receive

These service providers are authorized to use your personal information only as necessary to provide their services to us and are contractually obligated to protect your information.

We may also disclose your information if required to do so by law, regulation, legal process, or governmental request, or when we believe disclosure is necessary to protect our rights, your safety, or the safety of others.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the above categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

4. Cookies and Tracking Technologies

Cookies are small text files placed on your device when you visit our Site. We use the following types of cookies:

  • Essential cookies: Required for the Site to function, including shopping cart functionality, checkout, and security features. These cannot be disabled.
  • Analytics cookies: Help us understand how visitors interact with our Site (Google Analytics, Shopify Analytics).
  • Advertising cookies: Used to deliver relevant advertisements and measure campaign performance (Meta Pixel).

Managing cookies: You can control cookies through your browser settings. Most browsers allow you to block or delete cookies. Global Privacy Control and Do Not Track. Some browsers and extensions can transmit an opt-out preference signal, such as Global Privacy Control (GPC). There is currently no common industry standard for responding to "Do Not Track" browser signals, and we do not respond to them separately.

  • Order records: Retained for a minimum of seven (7) years for tax and accounting compliance
  • Account and contact information: Retained as long as your account is active or as needed to provide you with services
  • Marketing preferences and consent records: Retained until you unsubscribe or request deletion, and thereafter as needed to honor your opt-out and to evidence consent
  • Analytics data: Retained in accordance with each analytics provider's data retention policies

When your information is no longer needed, we will securely delete or anonymize it.

6. Your Rights and Choices

Depending on where you live, you may have some or all of the rights listed below. These rights are not absolute, may apply only in certain circumstances, and in certain cases we may decline a request as permitted by law. We honor the following for all customers wherever we reasonably can, regardless of location:

  • Correction: You may request that we correct inaccurate or incomplete personal information.
  • Deletion: You may request that we delete your personal information, subject to certain legal exceptions (such as tax record retention requirements).
  • Portability: You may request a copy of your personal information in a portable form, and in certain circumstances ask us to transfer it to a third party.
  • Restriction of processing: You may ask us to stop or restrict our processing of your personal information.
  • Withdrawal of consent: Where we rely on your consent, you may withdraw it at any time. Withdrawing consent does not affect processing carried out before the withdrawal.
  • Appeal: If we decline your request, you may appeal that decision by replying directly to our denial.
  • Opt out of marketing email: Unsubscribe at any time using the link in any marketing email, or by contacting us directly.

  • Opt out of targeted advertising: Use your browser settings, the opt-out links in Section 1, or the Digital Advertising Alliance's opt-out tool.

To exercise any of these rights, contact us at customersupport@ergosharp.com. We may need to collect information from you to verify your identity, such as your email address or order details, before providing a substantive response. In accordance with applicable law, you may designate an authorized agent to make a request on your behalf; we will require proof that you authorized the agent, and we may need to verify your identity directly with you. We will respond to verified requests within 45 days, or such shorter period as applicable law requires.

We will not discriminate against you for exercising any of these rights.

California Residents (CCPA/CPRA)

If you are a California resident, you have the right to:

  • Know what personal information we collect, use, and disclose
  • Request deletion of your personal information
  • Request correction of inaccurate personal information
  • Limit the use and disclosure of sensitive personal information
  • Opt out of the "sale" or "sharing" of personal information — we do not sell or share your personal information as those terms are defined under the California Consumer Privacy Act
  • Non-discrimination for exercising your privacy rights

Other U.S. State Privacy Laws

Residents of Virginia, Colorado, Connecticut, Utah, Texas, Oregon, Montana, and other states with consumer data privacy laws may have similar rights to access, correct, delete, obtain a copy of, and opt out of certain processing of their personal information. 7. Complaints

If you are not satisfied with our response, depending on where you live you may have the right to appeal our decision by contacting us again, or to lodge a complaint with your local data protection authority.

8. International Users

We are based in the United States and operate our Site from there. If you access our Site from outside the United States, please note that we may transfer, store, and process your personal information outside the country you live in, including in the United States. Your personal information may also be processed by staff and third-party service providers and partners in those countries.

If we transfer your personal information out of Europe or the United Kingdom, we will rely on a recognized transfer mechanism such as the European Commission's Standard Contractual Clauses, or an equivalent approved by the relevant competent authority, unless the transfer is to a country determined to provide an adequate level of protection.

We take reasonable administrative, technical, and physical measures to protect your personal information from unauthorized access, loss, misuse, or alteration. Our Site uses SSL/TLS encryption to secure data transmitted between your browser and our servers. Payment information is processed through PCI-DSS compliant payment processors and is never stored on our servers.

While we strive to protect your personal information, no method of transmission over the Internet or electronic storage is completely secure. We cannot guarantee absolute security.

10. Children's Privacy

Our Site and products are intended for dental professionals and dental students. We do not knowingly collect personal information from children under 16. If you are a parent or guardian and believe a child has provided us with personal information, please contact us at customersupport@ergosharp.com and we will promptly delete it.

As of the Last Updated date of this Privacy Policy, we do not have actual knowledge that we "share" or "sell" (as those terms are defined in applicable law) the personal information of individuals under 16 years of age.

Our Site may contain links to third-party websites, including our social media pages on Instagram, Facebook, and YouTube. This Privacy Policy applies only to our Site. We are not responsible for the privacy practices of other websites, and we encourage you to review their privacy policies before providing any personal information.
