SMS Program Terms

These SMS Program Terms govern the ErgoSharp text message program operated by DH Cubed, LLC ("ErgoSharp," "we," "us," or "our"). They are in addition to our Terms of Service and Privacy Policy.

By providing your mobile number and agreeing to receive text messages from ErgoSharp, you accept these terms.

1. About the Program

The ErgoSharp SMS program sends recurring marketing text messages to subscribers who have asked to receive them. Messages may include:

  • Sale announcements and discount codes
  • Educational pricing offers for faculty and students
  • New product and training module announcements
  • Event and conference notices

This program is separate from transactional messages about your order, such as shipping and delivery notifications. Opting out of marketing texts does not stop order notifications.

2. How You Join

You join the program by checking the SMS marketing box during checkout at ergosharp.com and providing a valid mobile number. The box is never pre-checked.

Consent is not a condition of purchase. You can buy any ErgoSharp product or training without joining the SMS program.

You must be at least 18 years old and the account holder, or have the account holder's permission, to enroll the mobile number you provide. The program is available for United States mobile numbers only.

3. Message Frequency

Message frequency varies. You can expect roughly 1 to 2 marketing messages per month, and no more than 6.

That count covers marketing messages only. It does not include replies we send when you text us first, and it does not include the single confirmation we send when you opt out.

4. Cost

Message and data rates may apply. ErgoSharp does not charge for the messages themselves, but your mobile carrier may charge you for sending and receiving them under your plan. Contact your carrier for details about your plan.

5. How to Stop Messages

Reply STOP to any message to end the program. You will receive one confirmation message, and then no further marketing texts.

You may also opt out by any other reasonable method, including:

We process opt-out requests as they arrive. If you opt out and later want to rejoin, check the SMS box again at your next checkout.

7. Sending Hours

We send marketing messages between 8:00 a.m. and 9:00 p.m. in your local time zone.

8. Carriers and Delivery

Delivery is subject to effective transmission by your mobile carrier and is outside our control. Carriers are not liable for delayed or undelivered messages. Supported carriers may change without notice.

Messages may not be available on all carriers or all devices.

9. Privacy and Your Mobile Data

Our Privacy Policy describes how we collect and use your information.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All of the categories of information sharing described in our Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We share your mobile number with our text message service provider only to the extent needed to deliver the messages you asked for.

10. Changes to These Terms

We may update these terms from time to time. When we make material changes, we will update the "Last Updated" date at the top of this page. Your continued participation in the program after changes are posted constitutes acceptance of the updated terms.
