Welcome to ErgoSharp. These Terms of Service ("Terms") govern your access to and use of the website at ergosharp.com (the "Site"), including any purchases, training content, and services offered by DH Cubed, LLC ("DH Cubed," "we," "us," or "our").

By accessing our Site, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use our Site or purchase our products.

1. Eligibility

Our products and training content are designed for dental professionals, including licensed dental hygienists, dentists, and enrolled dental hygiene or dental students. By using our Site, you represent that you are at least 18 years of age (or the age of majority in your jurisdiction) and have the legal capacity to enter into a binding agreement.

2. Products and Pricing

We strive to provide accurate product descriptions, images, and pricing on our Site. However, we do not warrant that product descriptions, images, pricing, or other content on the Site is complete, accurate, current, or error-free.

Prices are listed in U.S. Dollars (USD) and Canadian Dollars (CAD) and are subject to change without notice. All prices are exclusive of applicable taxes and shipping charges, which are calculated at checkout.

We reserve the right to limit order quantities, refuse any order, and correct pricing errors. If a product's correct price is higher than the listed price, we will contact you before processing the order to confirm whether you wish to proceed or cancel.

3. Orders and Payment

By placing an order through our Site, you are making an offer to purchase the selected products. We reserve the right to accept or decline any order at our sole discretion. An order is not considered accepted until we send you an order confirmation email.

Payment is processed securely through Shopify Payments at the time of purchase. We accept major credit and debit cards. You agree to provide accurate and complete payment information and authorize us to charge the payment method you provide for the total order amount, including applicable taxes and shipping fees.

4. Shipping

We currently ship to addresses within the United States and Canada. Shipping times and costs are calculated at checkout and may vary based on destination and shipping method selected.

Estimated delivery times are not guaranteed. DH Cubed is not responsible for delays caused by shipping carriers, customs processing, weather events, or circumstances beyond our control. Risk of loss and title for products pass to you upon delivery to the shipping carrier.

If your order arrives damaged or is lost in transit, please contact us at customersupport@ergosharp.com within 14 days of the expected delivery date so we can assist you in resolving the issue.

5. Returns and Refunds

Unopened Products

Unopened products may be returned for a full refund. To initiate a return, contact us at customersupport@ergosharp.com. We will approve the return and provide shipping instructions. The customer is responsible for return shipping costs.

Opened Products

Due to the nature of our products, opened or used products are not eligible for return or refund unless the product is defective (see Section 6 — Product Warranty below).

Refund Processing

Approved refunds will be processed to your original payment method within 10 business days of our receipt of the returned product. Shipping charges on the original order are non-refundable.

6. Product Warranty

DH Cubed warrants the ErgoSharp device against defects in materials and workmanship under normal use for a period of one (1) year from the date of purchase. This warranty applies only to the original purchaser and is non-transferable.

What Is Covered

If your ErgoSharp device is defective and needs to be returned under warranty, contact us at customersupport@ergosharp.com. We will approve the return and provide shipping instructions. You are responsible for shipping the defective unit to DH Cubed. We will pay for shipping the replacement unit back to you.

What Is NOT Covered

This warranty does not cover damage resulting from:

  • Misuse, abuse, negligence, or accident
  • Sterilization by any method, including but not limited to autoclaving, cold sterilization solutions, or immersion in liquid — ErgoSharp must only be disinfected by wiping down between patients; do not saturate the surface
  • Unauthorized modification, alteration, or repair
  • Normal wear and tear on consumable accessories (gel pads, rubber bands)
  • Damage caused by failure to follow product instructions or care guidelines

Warranty Disclaimer

EXCEPT FOR THE EXPRESS WARRANTY SET FORTH ABOVE, THE ERGOSHARP DEVICE IS PROVIDED "AS IS" AND DH CUBED DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

7. Training Content

Access

Purchase of the ErgoSharp Sharpening System includes access to our online self-instruction training modules: Sharpening Universal Curettes (Module 1), Sharpening Gracey Curettes (Module 2), and Sharpening Sickle Scalers (Module 3). Access to training content is granted to the original purchaser and is intended for individual, non-commercial use only.

Educational Disclaimer

Important: Our training modules are educational tools designed to teach proper sharpening technique using the ErgoSharp device. They do not constitute clinical instruction, do not offer clinical experience, and do not confer clinical competency. Participants should not assume competency in a clinical setting based solely on completion of our training modules.

Our training courseware teaches concepts, and our products are tools to assist in learning correct technique. The training is designed to be used in conjunction with proper clinical education and professional oversight. Participants are responsible for incorporating techniques safely and appropriately into their own clinical practice.

Participants of the training courses must be a licensed dental professional or a registered dental or dental hygiene student.

Intellectual Property

All training videos, text, images, graphics, and course materials are the exclusive property of DH Cubed, LLC and are protected by copyright and intellectual property laws. You may not reproduce, distribute, modify, create derivative works from, publicly display, or otherwise exploit any training content without our prior written permission.

8. Intellectual Property

All content on this Site — including but not limited to the ErgoSharp name, logo, product designs, website design, text, graphics, images, videos, and software — is the property of DH Cubed, LLC or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws.

"ErgoSharp" and the ErgoSharp logo are trademarks of DH Cubed, LLC. You may not use our trademarks without our prior written consent.

You are granted a limited, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes. This license does not permit you to download (other than page caching), modify, or reproduce any portion of the Site without our express written consent.

9. User Accounts

If you create an account on our Site, you are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately at customersupport@ergosharp.com if you suspect unauthorized access to or use of your account.

We reserve the right to suspend or terminate accounts at our discretion if we reasonably believe a violation of these Terms has occurred.

10. Prohibited Uses

You agree not to use our Site or products to:

  • Violate any applicable local, state, national, or international law or regulation
  • Infringe upon the intellectual property or other rights of DH Cubed or any third party
  • Transmit any viruses, malware, or other harmful code
  • Attempt to gain unauthorized access to any portion of the Site, other accounts, or any systems or networks connected to the Site
  • Use any automated system (bots, scrapers, etc.) to access or collect data from the Site without our express written permission
  • Resell, redistribute, or commercially exploit our products or training content without authorization
  • Misrepresent your identity or affiliation with any person or organization

11. Disclaimer of Warranties

EXCEPT FOR THE EXPRESS PRODUCT WARRANTY IN SECTION 6, THE SITE AND ALL CONTENT, PRODUCTS, AND SERVICES OFFERED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

DH CUBED DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SITE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

DH CUBED MAKES NO WARRANTIES OR REPRESENTATIONS REGARDING THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT ON THE SITE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DH CUBED, LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO:

  • Your use of or inability to use the Site or any products purchased through the Site
  • Any errors, omissions, or inaccuracies in Site content
  • Personal injury or property damage resulting from your use of our products
  • Unauthorized access to or alteration of your transmissions or data
  • Any third-party conduct or content on or through the Site

IN NO EVENT SHALL DH CUBED'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SITE EXCEED THE AMOUNT YOU PAID TO DH CUBED FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN WARRANTIES OR DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

13. Indemnification

You agree to indemnify, defend, and hold harmless DH Cubed, LLC, its officers, directors, employees, partners, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to your violation of these Terms, your use of the Site, or your use of any products or training content purchased through the Site.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or your use of the Site shall first be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through binding arbitration administered in accordance with the rules of the American Arbitration Association, conducted in the State of Washington. Judgment on any arbitration award may be entered in any court of competent jurisdiction.

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights.

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted on an individual basis only, and not in a class, consolidated, or representative action.

15. Third-Party Links and Services

Our Site may contain links to third-party websites or services that are not owned or controlled by DH Cubed. We are not responsible for the content, privacy policies, or practices of any third-party websites or services. Your use of third-party websites is at your own risk and subject to the terms and conditions of those websites.

16. Modifications to Terms

We reserve the right to update or modify these Terms at any time. When we make material changes, we will update the "Last Updated" date at the top of this page and, where appropriate, provide additional notice (such as by email or through a notice on the Site).

Your continued use of the Site following the posting of updated Terms constitutes your acceptance of the changes. If you do not agree with the modified Terms, you must stop using the Site.

17. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DH Cubed, LLC regarding your use of the Site, and supersede any prior agreements, communications, or understandings, whether written or oral.
